USPTO proposes new and increased fees for fiscal year 2025

The United States Patent & Trademark Office (USPTO) recently published its proposed new fees to go into effect October 1, 2024.

Here is a brief summary:

1. If an applicant files a continuation application more than 5 years after the earliest claimed priority or benefit date, they will pay $2,200 and after 8 years the fee goes to $3500.
2. 2nd and 3rd RCE’s will have a 25-80% fee increase.
3. There will be a 100% increase in fees for claims in excess of 20.
4. There is a proposed fee increases of $800 for filing a Terminal Disclaimer after a final action or a notice of allowance.
